Celebramos que la Asamblea General AGNU haya votado mayoritariamente su apoyo (A\/ES-10\/L.31\/Rev.1 of September 13 2024) a la opini\u00f3n consultiva de la Corte Internacional de Justicia (CIJ) (AO of 19 July 2024) sobre los efectos nefastos de la ampliaci\u00f3n de la acci\u00f3n militar y de inseguridad en estos territorios, tal como lo ha se\u00f1alado el Comit\u00e9 en sus recientes recomendaciones (CRC\/C\/ISR\/CO\/5-6) del 16 de septiembre de 2024 durante el di\u00e1logo peri\u00f3dico con el Estado de Israel. Los informes presentados ante el Comit\u00e9 describen un panorama devastador de violaciones sistem\u00e1ticas a los derechos de los ni\u00f1os palestinos, que re\ufb02ejan el incumplimiento persistente de las obligaciones internacionales de Israel bajo la Convenci\u00f3n sobre los Derechos del Ni\u00f1o y el derecho internacional humanitario. Adem\u00e1s, el Comit\u00e9 expres\u00f3 profunda preocupaci\u00f3n por la expansi\u00f3n de acciones de guerra al L\u00edbano, que han victimizado a decenas de ni\u00f1os, con el riesgo que esto signi\ufb01ca de un potencial con\ufb02icto de envergadura regional.<\/p>\n\n\n\n<p>El Estado de Israel, como potencia ocupante, tiene la obligaci\u00f3n de proteger a todos los ni\u00f1os y ni\u00f1as bajo su control, pero las acciones documentadas en Gaza y Cisjordania demuestran un <strong>incumplimiento grave y sistem\u00e1tico <\/strong>de estas responsabilidades. El Comit\u00e9 lamenta que el Estado parte contin\u00fae negando las obligaciones legales bajo la Convenci\u00f3n en los TPO bas\u00e1ndose en que \u00e9sta <em>\u201cno se aplica a \u00e1reas m\u00e1s all\u00e1 del territorio del Estado nacional\u201d <\/em>y <em>\u201cque no fue dise\u00f1ada para situaciones de con\ufb02ictos armados\u201d<\/em>, opini\u00f3n que ha sido sistem\u00e1ticamente opuesta por la CIJ y el<\/p>\n\n\n\n<p>propio Comit\u00e9: el Estado parte como ocupante no puede negarse a aplicar la Convenci\u00f3n y otros instrumentos internacionales que ha adoptado para justi\ufb01car los graves y persistentes atropellos al derecho de los derechos humanos y a la ley humanitaria internacional.<\/p>\n\n\n\n<p>Las recomendaciones del Comit\u00e9 son claras al exigir una <strong>acci\u00f3n inmediata para proteger a la infancia <\/strong>en Gaza y Cisjordania. Las violaciones se\u00f1aladas incluyen la <strong>detenci\u00f3n arbitraria de ni\u00f1os palestinos<\/strong>, sometidos a condiciones que constituyen tortura y tratos crueles, y el uso de fuerza desproporcionada en zonas civiles, lo cual agrava el sufrimiento de ni\u00f1os y ni\u00f1as. Las condiciones de vida se han deteriorado al punto de que los ni\u00f1os palestinos enfrentan no solo la violencia f\u00edsica y la represi\u00f3n, sino tambi\u00e9n un estado constante de desamparo psicol\u00f3gico y hambruna. Es imperativo que se garantice <strong>acceso irrestricto a la ayuda humanitaria<\/strong>, que permita la recuperaci\u00f3n y protecci\u00f3n de los derechos fundamentales de estos ni\u00f1os, incluido en los TPO.<\/p>\n\n\n\n<p>Por otro lado, el Comit\u00e9 tambi\u00e9n ha resaltado la necesidad de abordar la situaci\u00f3n de la ni\u00f1ez en Israel, particularmente en lo que respecta a la <strong>militarizaci\u00f3n del sistema educativo<\/strong>. La infancia israel\u00ed debe crecer en un entorno que fomente la paz y el respeto mutuo, evitando que las ideolog\u00edas que perpet\u00faan la violencia y la discriminaci\u00f3n se arraiguen en las nuevas generaciones. Es crucial que las ni\u00f1as y ni\u00f1os en Israel reciban una <strong>educaci\u00f3n basada en la paz y la <\/strong><strong>convivencia<\/strong>, promoviendo valores de tolerancia y respeto hacia todos los pueblos.<\/p>\n\n\n\n<p>La comunidad internacional debe asumir su responsabilidad \u00e9tica y legal. Las resoluciones de Naciones Unidas, las decisiones de la Corte Internacional de Justicia y las recomendaciones del Comit\u00e9 de Derechos del Ni\u00f1o y otros organismos internacionales no son solo palabras al viento. Es imperativo movilizar las voluntades \u00e9ticas y pol\u00edticas para asegurar su cumplimiento. <strong>Un alto al <\/strong><strong>fuego inmediato con embargo de armas y liberaci\u00f3n de rehenes y presos detenidos arbitrariamente <\/strong>es imprescindible para detener la violencia y proteger a los civiles, en particular a los ni\u00f1os, cuyas vidas y futuro est\u00e1n siendo destrozados por el con\ufb02icto.<\/p>\n\n\n\n<p>La protecci\u00f3n de la infancia es una prioridad que no puede ser negociada, y es responsabilidad de la comunidad internacional garantizar que estos derechos sean una realidad para cada ni\u00f1a y ni\u00f1o en la regi\u00f3n y en el mundo. We welcome the majority vote of the UNGA General Assembly in support (A\/ES-10\/L.31\/Rev.1 of September 13, 2024) of the advisory opinion of the International Court of Justice (ICJ) (AO of 19 July 2024) on the harmful e\ufb00ects of the expansion of military action and insecurity in these territories, as noted by the Committee in its recent recommendations (CRC\/C\/ISR\/CO\/5-6) of 16 September 2024 during the periodic dialogue with the State of Israel. The reports submitted to the Committee paint a devastating picture of systematic violations of the rights of Palestinian children, re\ufb02ecting Israel&#8217;s persistent failure to comply with its international obligations under the Convention on the Rights of the Child and international humanitarian law. The Committee also expressed deep concern about the expansion of war actions into Lebanon, which have victimized dozens of children, with the risk that this poses of a potential regional con\ufb02ict.<\/p>\n\n\n\n<p>The State of Israel, as the occupying power, has an obligation to protect all children under its control, but the documented actions in Gaza and the West Bank demonstrate a serious and systematic failure to ful\ufb01l these responsibilities. The Committee regrets that the State party continues to deny its legal obligations under the Convention in the OPT on the grounds that it \u201cdoes not apply to areas beyond the territory of the national State\u201d and \u201cwas not designed for situations of armed con\ufb02ict\u201d, a view that has been consistently opposed by the ICJ and the Committee itself: the State party as the occupying power cannot refuse to apply the Convention and other international instruments it has adopted in order to justify the serious and persistent violations of human rights law and international humanitarian law.<\/p>\n\n\n\n<p>The Committee\u2019s recommendations are clear in demanding immediate action to protect children in Gaza and the West Bank. The violations noted include the arbitrary detention of Palestinian children, subjected to conditions that amount to torture and cruel treatment, and the use of disproportionate force in civilian areas, which aggravates the su\ufb00ering of children. Living conditions have deteriorated to the point that Palestinian children face not only physical violence and repression, but also a constant state of psychological helplessness and famine. It is imperative that unrestricted access to humanitarian aid be guaranteed, allowing for the restoration and protection of the fundamental rights of these children, including in the OPT.<\/p>\n\n\n\n<p>On the other hand, the Committee has also highlighted the need to address the situation of children in Israel, particularly with regard to the militarization of the educational system. Israeli children must grow up in an environment that fosters peace and mutual respect, preventing ideologies that perpetuate violence and discrimination from taking root in the new generations. It is crucial that girls and boys in Israel receive an education based on peace and coexistence, promoting values of tolerance and respect towards all peoples.<\/p>\n\n\n\n<p>The international community must assume its ethical and legal responsibility. United Nations resolutions, decisions of the International Court of Justice and recommendations of the Committee on the Rights of the Child and other international bodies are not just words in the wind. It is imperative to mobilize ethical and political wills to ensure their implementation. An immediate cease\ufb01re with an arms embargo and the release of hostages and arbitrarily detained prisoners is essential to stop the violence and protect civilians, particularly children, whose lives and futures are being shattered by the con\ufb02ict.<\/p>\n\n\n\n<p>The protection of children is a priority that cannot be negotiated, and it is the responsibility of the international community to ensure that these rights are a reality for every girl and boy in the region and in the world.
